Welcome to Dark Mortgage. By accessing or using our mortgage analysis and investment comparison tool, you agree to be bound by these Terms of Service. Please read them carefully.

1. Description of Service

Dark Mortgage provides a web-based calculator and analysis tool that helps users:

  • Model mortgage scenarios including fixed-rate and adjustable-rate mortgages (ARM)
  • Calculate amortization schedules with additional payments
  • Compare mortgage prepayment strategies versus alternative investment scenarios
  • Perform Net Present Value (NPV) analysis and other financial comparison methods

Our tool uses publicly available data sources including FRED (Federal Reserve Economic Data), treasury rates, market indices, and tax rate information. We make reasonable efforts to keep this data current, but we do not guarantee its accuracy or timeliness.

2. No Warranty on Calculations

While we strive for accuracy, we provide no warranty regarding the correctness, completeness, or reliability of our calculations, data, or analysis results.

Data Sources May Be Outdated or Incorrect:

  • FRED rates, treasury yields, and market index data may not reflect current market conditions
  • Tax rates and regulations change frequently and vary by jurisdiction
  • ARM calculations use estimated index values that may not match your actual loan terms
  • Investment return assumptions are hypothetical and not predictive of future performance

You are responsible for verifying all inputs, reviewing all outputs, and independently confirming the accuracy of any calculations before making financial decisions.

3. User Responsibilities

By using Dark Mortgage, you agree to:

  • Provide accurate information when using the calculation tools
  • Verify all calculations and results independently
  • Not rely solely on our tool for making financial decisions
  • Seek professional financial advice before implementing any strategies
  • Use the service only for lawful purposes and in compliance with all applicable laws
  • Not attempt to reverse engineer, decompile, or extract our calculation algorithms

4. Account Tiers and Payments

Free Tier:

The free tier provides access to basic mortgage calculations and limited analysis features. We reserve the right to modify or discontinue free tier features at any time.

Pro Tier:

The Pro tier provides enhanced features including advanced investment analysis, and comprehensive reports. Pro users purchase credits that are used to perform investment analyses and access premium features. The number of analyses you can run depends on your available credit balance. Credits are purchased in packs as specified at the time of purchase and do not expire.

Payment Processing:

Payments are processed through Stripe. By purchasing credits, you also agree to Stripe's terms of service. We do not store your payment card information.

Refunds:

Due to the nature of digital services, all sales are final. We do not offer refunds for credit purchases except as required by law.

5. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or other reasons at our sole discretion. You may delete your account at any time through your account settings.

Upon account deletion, all personally identifiable information will be removed from our systems. Note that your financial calculation data (mortgage scenarios, analysis results) is not stored on our servers—it exists only in your browser's local storage.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARK MORTGAGE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Financial losses resulting from use of our tools
  • Decisions made based on our calculations or analysis
  • Errors, omissions, or inaccuracies in data or calculations
  • Service interruptions, data loss, or technical failures
  • Tax penalties, missed investment opportunities, or other financial consequences

In jurisdictions that do not allow the exclusion or limitation of liability for consequential damages, our liability is limited to the greatest extent permitted by law. In no event shall our total liability exceed the amount you paid for Pro tier services in the 12 months preceding the claim.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

8. Intellectual Property

All content, features, functionality, and intellectual property rights in Dark Mortgage, including but not limited to calculation algorithms, user interface design, and analysis methodologies, are owned by Dark Mortgage or its licensors.

You may not copy, modify, distribute, sell, or reverse engineer any part of the service without our express written permission.

9. Privacy

Your use of Dark Mortgage is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of the service after changes are posted constitutes your acceptance of the modified terms.

Material changes will be communicated via email to registered users when possible.

11. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Dark Mortgage operates, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

12. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
